Statement:
Digital Identities Act

The Federal Government has adopted a draft Digital Identities Act. The Act is intended to implement the provisions of EU law regarding the European Digital Identity (EUDI) Wallet. The EUDI Wallet is an electronic identification tool designed to enable its users to securely store, manage, and validate personal identification data as well as certificates for authenticating attributes, rights, or authorizations that are available in electronic form (electronic attribute certificates).

Separation of professional and private Spheres

In its statement of 3 August 2026, to the committees of the German Bundestag, the WPK suggested that WP/vBP be allowed, in their own practice, to separate their professional and private spheres within the EUDI Wallet. The government’s draft bill merely provides for the possibility of using one’s private digital identity for professional purposes. From the WPK’s perspective, this is unacceptable, particularly in light of the fact that the capabilities of the EUDI Wallet will extend far beyond identification and attribute certificates.

Furthermore, the WPK has proposed that powers of legal representation should also be reflected in the EUDI Wallet. In the WPK’s view, power-of-attorney databases should be designated as authentic sources for this purpose.
